DESPATCH
The Tea Towel Shop will post your purchase as soon as possible, usually within 1 working day. If there is likely to be a delay of more than 2 working days we will post a message on our website.

We will notify you by email when we we have posted your order. If we have any queries regarding your order we will communicate with you by email as this ensures we both have a record of our communicaton. Please contact us if you have any queries regarding your order at any stage.

Postage - your parcel will be sent by the service you choose during the checkout process. We will sometimes, at our discretion and at no extra charge to you, send your order by a signed-for service.
For some overseas countries we only offer a Signed For service.

CUSTOMERS OUTSIDE EUROPEAN UNION
A Customs Declaration form will be attached to the front of your parcel clearly indicating the contents and value. You will be responsible for any customs/import duties appropriate to the country of import.

RETURNS POLICY
We sincerely hope you are happy with your purchase however we do understand that there are times when an item needs to be returned.

Change of Mind
You have a 14 day cooling-off period which starts when you receive the goods to cancel all or part of your purchase. Should you decide you do not wish to purchase the items they must be returned to us unused, unopened, and in their original packaging within that period. Please contact us for a returns number before returning the items. We will refund the cost of the item(s) returned and the P&P element of your original purchase when they are received by us. You will be responsible for the cost of return postage. Should the goods not be received in the same condition as they were sent to you we reserve the right to charge an appropriate fee.

Faulty or Not as Described
If your goods are faulty or not as described we will replace (wherever possible) or refund the purchase price (including postage and return postage) if the goods are returned to us in original unopened condition within 14 days of receipt.
Please contact us for a returns number before returning your goods. Should the goods not be received in the same condition as they were sent to you we reserve the right to charge an appropriate fee.

Goods received Damaged
We certainly hope your items arrive in good condition, however should they arrive damaged please keep all of the packaging & contents, and contact us via email immediately. It would be a help if you could also take a photograph of the damged item(s) & packing.

UK customers
Please contact us before returning items for a returns number. For your peace of mind we recommend you obtain a Certificate of Posting, or use a Signed For delivery service, as this will enable you to claim compensation from the Post Office should your returned parcel get damaged or go astray on its journey back to us. We are unable to refund monies if items are not safely received by us.

Overseas customers
Please contact us before returning items. We recommend that you use a trackable method of returning items as we are unable to refund monies if items are not safely received by us.

If you are returning goods from overseas you must clearly mark the package "Returned goods of UK origin" to enable UK Customs clearance. If you do not do this and Customs charge duty on the return we will reject the package and it will be returned to you at your expense.

YOUR PARCEL DOES NOT ARRIVE ?
Although the vast majority of items sent via Royal Mail are delivered as expected, Royal Mail does not accept that items are lost or missing in the post until after 15 working days (UK addresses), 20 working days (European addresses) and 25 working days (rest of the world) from the date of posting.

If you are concerned that your parcel has gone astray please do let us know, however we will be unable to replace (wherever possible) or refund until 15 working days (UK), 20 working day (Europe), 25 working days (rest of the world), have elapsed since the posting date

Should we need to claim for a lost parcel you may be contacted by Royal Mail during their investigation process.

PRIVACY POLICY
Busy Lizzie Crafts and The Tea Towel Shop are committed to protecting the privacy of all our customers and visitors in accordance with the Data Protection Act 1998.

Purchases -
We collect your name, address, email address & telephone number to enable us to process your order and communicate with you to provide you with the best possible service. We will not pass on your details to a third party except where your purchase is being delivered directly to you from the designer/manufacturer OR where we are legally obliged to do so - please ask if you have any queries.

Information Sharing - we may share the information you provide during the checkout process with another organisation. This information will only be used to fulfil your order, or to contact you regarding your order, or to contact you regarding a failed payment.

Accounts - You do not need to create an account to purchase from The Tea Towel Shop . However should we offer the facility to create an account the details you provide when creating an account are no more than is required to enable The Tea Towel Shop to process your order and to contact you via email or telephone if we have a query.

Mailing Lists - Should you decide to join our Mailing List (should we offer one) you will be able to unsubscribe via a link when you receive a mailing, or by sending us an email. We value your privacy and will not pass your details to a third party.

Cookies - Cookies are small files that a site, or its service provider, transfer to your computer's hard drive through your web browser to allow the site, or its service provider, to capture and remember certain information. Your web browser should allow you to automatically accept cookies or refuse to accept cookies unless prompted.

We use cookies on our website to remember and process the items in your shopping cart, and to compile general data about site traffic and customer interaction.

As with many websites if you choose to switch off all cookies you may find that our shopping cart service will not function properly, however you may still purchase items by contacting us.


GENERAL TERMS AND CONDITIONS
Please read these terms and conditions carefully as it governs the relationship between you and us, and limits our liability to you when you purchase products from us. By accepting these terms and conditions you are forming a contract with us and agreeing to the terms and conditions that appear below. References to “you” and “your” are to you as an individual. References to “us”, “our” and “we” are to Our Shop.

1. Your Order

1.1 Each order placed by you with us shall be an offer by you to us to buy products subject to these and the website terms and conditions.

1.2 No order you place shall be deemed to be accepted by us until we have received payment from you and issued confirmation of the order.

1.3 You must ensure that the terms of your order, including the address for delivery, and contact details in case of query, are complete and accurate.

1.4 All quotations and advertisements for products given on this website are given on the basis that no contract for sale shall come into existence between us and you until we have received payment from you and issued acknowledgement of your order. Any quotations or advertisements for products given on this website may be altered or withdrawn by us at any time.

1.5 We shall endeavour that all orders are met. We do not, however, guarantee the availability of any product at any time. Where a product is temporarily out of stock we will advise you of when we expect to be able to fulfil orders, however this is an estimate only and shall not be binding upon us.

1.6 Sometimes stock may be withdrawn or discontinued. We shall make every effort to update the website at all times, but you understand and acknowledge that we are not liable to you for any failure or delay to fulfil an order due to products being out of stock, withdrawn or discontinued.

1.7 Once the products have been despatched, and you have been sent our confirmation of despatch email, we are unable to cancel any orders and our Returns Policy will then apply

2. Delivery

2.1 Delivery of the products shall take place at the delivery address contained in your order.

2.2 Any dates or times specified by us for delivery of the products are intended to be estimates only and time of delivery shall not be of the essence, and shall not be made of the essence by notice.

2.3 Subject to the other provisions contained in these terms and conditions, we shall not be liable for any direct, indirect or consequential loss (all three terms which include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar losses), costs, damages or expenses caused directly or indirectly by any delay in the delivery of the products (even if caused by our negligence).

2.4 If for any reason you or the person at the delivery address refuses to accept delivery of the products, all risk in the products shall pass to you and we may, at our discretion, charge for return of the products to us, a storage fee and a redelivery fee to another address nominated by you.

2.5 The cost of delivery shall be calculated when you place your order with us and payment shall be due at the time of payment for the products.

3. Price and Payment

3.1 Unless otherwise agreed between you and us, the price for the products shall be the price advertised on the website as published on the date of the order.

3.2 The price for the products shall be exclusive of VAT (Neither Busy Lizzie Crafts nor The Tea Towel Shop are not VAT registered) and exclusive of all fees and charges in relation to packaging, carriage and (optional) insurance to the delivery address (unless otherwise indicated). The cost of packing & carriage is additional, and is calculated during the checkout process.

3.3 Payment for the price of the products shall be due in pounds sterling at the time of the order.

3.4 Time of payment shall be of the essence and no payment shall be deemed to be received by us until it has been received in full and cleared funds.

4. Warranties

4.1 All warranties, conditions and other terms implied by state or common law are, to the fullest extent permitted by law, excluded from this Agreement.

4.2 All products carry the warranty stated on the product description.

4.3 We shall only extend the benefit of the manufacturer’s warranty to you, and do not separately warranty the products ourselves.

4.4 In the event of the product requiring replacement or repair under the warranty, you must contact the manufacturer directly.

5. Returns and Refund Policy

5.1 In the event that any order is incorrect, it must be notified to us within 7 (seven) days after delivery.

5.2 In the case of incorrect orders, the products shall be returned to us and we shall redeliver the correct order at our own cost.

5.3 If any products are faulty or defective, they must be returned to us within 14 days of delivery. If we are unable to replace the item we shall provide a refund of the price paid by you. In the event of replacement of any products, the products returned to us shall become our property.

5.4 If we elect to refund you rather than provide a replacement or repair for faulty or defective products, or we are unable to replace any faulty or defective product, the products must be returned to us, at our cost, and shall become our property.

6. Limitation of Liability

6.1 Without prejudice to the other provisions in these terms and conditions, these provisions set out our total financial liability to you.

6.2 All times given for delivery, restocking etc. are estimates only and we shall not be liable for any damages, costs, losses (including without limitation pure economic loss, loss of profit, loss of business, interruptions to business, depletion of goodwill or reputation, and/or loss of commission), claims or liabilities, whether direct, indirect or consequential, incurred by you due to any delay by us, including if such delay was caused by our negligence.

6.3 Nothing in this agreement shall limit our liability for death or personal injury caused by our negligence or for any matter for which it would be illegal for us to attempt to exclude our liability or for fraud or fraudulent misrepresentation.

6.4 Without prejudice to the other provisions of this agreement, our total liability in contract, tort (including negligence or breach of statutory duty) misrepresentation, restitution or otherwise, arising in the performance or contemplated performance of this Agreement shall be limited to the price of the products in any single order.

7. Waiver

7.1 If you breach any provision of these terms and conditions or the terms of use of the website and we ignore this, we shall still be entitled to use our rights and remedies at a later date or in any other situation where you breach any provision of these terms and conditions.

8. Assignment

8.1 We may transfer and/or assign our rights or obligations under these terms and conditions at any time. This will not affect your rights and/or obligations under the terms and conditions. You are not permitted to transfer your rights or obligations under these terms and conditions to any other person.

9. Invalidity

9.1 If any provision of these terms and conditions is found by any court, tribunal or administrative body of competent jurisdiction, to be wholly or partially illegal, invalid, void, voidable or unenforceable it shall, to such extent, be deemed to be severable and the remaining provisions of the terms and conditions and the remainder of the provision shall continue in full force and effect.

10. Privacy

10.1 Busy Lizzie Crafts and The Tea Towel Shop value your privacy and will not pass your details to a third party unless we are legally obliged to.
